How do I file for divorce?

You can file a Petition for Divorce yourself and act as your own attorney.  However, we do not provide any forms.  We are not attorneys; therefore, any instructions we give could be considered practicing law without a license.

How much is the fee to file a pleading?

You may obtain fee information by clicking on the forms link on this web site.

What can I do if I can not afford an attorney?

You may obtain information by going to http://childsupport.oag.state.tx.us or Legal Aid of Northwest Texas at http://www.lanwt.org  (888) 529-5277.

What form of payment is accepted?

Cash or money order.

How long does it take to get divorce?

The time frames for completion of a divorce vary by case.  The shortest time frame is 61 days.

Where do I file Civil or Family pleadings?

All pleadings to be filed in the District Courts can be filed in the District Clerk’s Office, located in the Wise County Courthouse at 101 N. Trinity, Suite 102, Decatur, Texas or by mail at P.O. Box 308, Decatur, Texas  76234.

How can I have child support payments taken out of my paycheck?

This information may be obtained by clicking on the Forms link (Request for Issuance of Employers Order for Withhold) link on the web site.

How do I get a trial setting?

You must contact the Court Coordinator for the 271st District Court at (940) 627-3200 or County Court at law #2 at  940-683-0268 to obtain a setting.
